Design Right and Copyright

Design right provides protection for the shape and configuration of an article. It protects a new industrial design without the need for any registration procedure.

Copyright is a property right providing protection for authors in respect of work they create.  The work can be in a variety of forms, for example artistic, literary, or even software. Copyright comes into existence automatically without any registration formalities.

Both a design right and copyright provide protection only against copying and not against a third party who independently comes up with a similar design.

We advise on the scope of a third party's design right and copyright and whether products created by you are entitled to such protection. Working with carefully chosen Attorneys around the world, we can advise on how you may need to protect your design right or copyright in other countries.
